Attorney Files Change Of Venue Motion For Amber Guyger Trial

DALLAS (1080 KRLD) - The lawyers for former Dallas police officer Amber Guyger have filed a change of venue motion Monday, claiming she cannot get a fair trial in Dallas County.

Guyger is facing a murder charge after she killed Botham Jean inside his apartment. She told police she had mistaken his apartment for hers.

In the motion, the attorneys claim the pervasive and prejudicial nature of the media coverage of the case, as well as comments made by former District Attorney Faith Johnson, have made a fair trial in Dallas County impossible.

They suggest other counties like Collin, Ellis, Fannin, Grayson, Kaufman and Rockwall as alternates.

KRLD legal analyst Ed Klein says this move was expected.

"In any case where you have mass publicity like this, the defense attorney is going to look at the prospect of moving the case out of the county, in order to get an impartial jury," Klein says.

He says the leaked 9-1-1 call Guyger made on the night of the shooting, furthers her lawyer's claim.

The judge likely will not take up hearing until next month.

Her trial is scheduled for September.
