DALLAS (1080 KRLD) - The man who won the Democratic nomination for Dallas County District Attorney is asking the lawsuit that challenges the primary election be dismisssed.

Former Judge John Creuzot gives a number of reasons why he wants the lawsuit by ex-judge Elizabeth Frizell tossed.

Creuzot won the primary election by 589 votes, and Frizell is challenging the election.

Creuzot's legal pleadings say Frizell has made baseless claims of voter fraud involving mail-in ballots, accusations that cannot be proven that some voters were turned away  - and that an allegation of insufferable delays at polling places lacks specificity.

What's more Creuzot claims Frizell waited too long to file her suit.

Creuzot's lawyers say it's enough and they want the lawsuit dismissed so Creuzot can get on with the campaign.

So far, both sides are still waiting for an outside judge to be assigned the case.
