DALLAS (1080 KRLD) - A federal judge has refused to throw out a lawsuit filed against Collin County by former judge Suzanne Wooten.

Federal Judge Amos Mazzant has ruled that the Collin County District Attorney's office was "acting as investigators searching for probable cause, as opposed to actingas prosecutors with probable cause preparing for prosecution" in bringing bribery and money laundering charges against Wooten, shortly after she was elected State District Judge in Collin County.

Wooten was convicted of charges, that were eventually dismissed.

Wooten has filed the federal civil rights suit againt the county, former District Attorney John Roach Senior, an assistant prosecutor, Governor Greg Abbott, who was the Texas attorney general at the time, and one of his assistants.

The ruling clears the way for more legal action in the federal suit. Mazzant's ruling can also be appealed.
