DALLAS (1080 KRLD) - One of the last two surviving Texas Seven members has failed to convince a federal appeals court to give him another hearing.

The 5th Circuit today rejected Randy Halprin's appeal. Halprin was the gang member who mapped-out the Christmas Eve, 2000 robbery of the Oshman's Sporting Goods in Irving. That's where Police Officer Aubrey Hawkins was ambushed and murdered.

Halprin tried to convince the appeals court there was new evidence, but the justices refused to hear the case.

Halprin and Patrick Murphy are the last two gang members on death row.

Murphy is slated for execution in March.

Earlier this month Joseph Garcia was put to death.
