Lethal Injection,

HUNTSVILLE (1080 KRLD) - The first execution of 2020 in Texas, and the nation, took place Wednesday night in Huntsville.

John Gardner was given a lethal injection for the murder of his wife Tammy Gardner.

Texas Department of Criminal Justice spokesman Robert Hurst says the couple was wed in 1999, and their marriage was violent with Gardner hitting and choking Tammy and threatening her with a gun.

She filed for divorce in December 2004, and told co-workers she feared her would kill her. "On January 23rd, 2005, just 15 days before the divorce would become final Gardner drove from Mississippi, broke into Tammy's house and shot her in the head as she sat in bed."

She was able to call 911 and identify him before she died.

Tammy was Gardner's fifth wife.  His previous wives also accused him of abuse.

In 1983, he shot his pregnant wife Rhoda in Mississippi. She later died and he was convicted of aggravated assault. He served two years of an eight year sentence.

While on parole, he assaulted the daughter of his new wife and at knifepoint, kidnapped his wife.

Hurst says Gardner's execution was witnessed by Tammy Gardner's mother, daughter and son and friend's of John Gardner.

"In Gardner's final statement, he did apologize to his victim's family and ask for their forgiveness, as well as to his friends."
