A family's excessive-force lawsuit against five Dallas police officers has been tossed by a federal judge.

Four years ago, Tony Timpa was pronounced dead from what the autopsy determined was sudden cardiac death blamed on the "toxic effects" of cocaine along with stress from the physical restraint used by the Dallas officers.

Yesterday, US District Judge David Godbey dismissed the lawsuit filed by Timpa's family, citing the doctrine of "qualified immunity" enjoyed by police during the course of their duties.

The family's lawyer vows to appeal.
