US Magistrate: Lawsuit Against Balch Springs Over Teen's Death Can Proceed

A US Magistrate is recommending that the federal lawsuit against the City of Balch Springs, brought by the family of a teenager killed by a police officer, move forward.

Jordan Edwards was a 15-year old who was a passenger in a car that was leaving a loud party when he was killed by former officer Roy Oliver.

During his murder trial, Oliver tried to claim he opened fire because the car posed a threat.

Edwards' parents are suing the city over its training policy.

The City is asking that the lawsuit be dismissed. But in a lengthy opinion, US Magistrate Rebecca Rutherford says the allegation that the training Balch Springs provided its officers seems to fly in the face of the Supreme Court guidelines.

A federal judge will make a final ruling.
