DALLAS (KRLD) - A vote in Dallas will require a controversial car wash to close up shop.

The city's board of adjustments decided to close down Jim's car wash on MLK blvd.

The vote took place weeks after a shooting left 56 year old Sheila Sanders dead and four others hurt. However, the city says the car wash has been in noncompliance for months, due to changes in zoning laws. They also deemed it to be a public safety concern.

Owner Dale Davenport told the board he will shut down, but needs time to raise that money.

"I have to put up a fence, remove pumps, equipment and timers. Total cost of this is $12,500 bucks. If you allow me 60 days to stay open, I believe I can make enough money by cutting costs and slowing capacity," he told the board.

The board gave him 30 days to close down.

Davenport is already preparing a lawsuit against the city.
