South Texas Grand Jury Indicts Man For Killing 11-Year-Old

Harris County District Attorney Kim Ogg says newly tested DNA evidence ties Andre Jackson to the murder of 11-year-old Josue Flores.

Investigators say the little boy was stabbed around 20 times while he walked home from a middle school in 2016.

The indictment marks the second time Jackson has been charged with murdering Josue.

Prosecutors asked that murder charge indictment against Jackson be dismissed in 2017 until and if additional evidence was found. 

The judge granted that dismissal.

If prosecutors had proceeded to trial at that time, and Jackson had been found not guilty, double jeopardy would have prevented this charge. However, by dismissing the case against Jackson at that time, they reserved the right to charge him again should additional evidence be discovered.

If convicted, Jackson could face anywhere from five to 99 years in prison, or life.
