DALLAS (1080 KRLD) - The man police say crossed the center line of East Ledbetter and hit a former Dallas City Councilwoman's car this week has been released from the hospital and booked into jail.

Jonathan Alger Moore, 36, has now been charged with a second count of intoxication manslaughter.

Carolyn Davis died Monday night. She was driving the car when police say Moore crossed the center line.

Her daughter, Melissa Davis-Nunn, 27, went to the hospital in critical condition. Police say Davis-Nunn passed away Tuesday.

An arrest warrant affidavit says Moore told paramedics he had taken Xanax before the crash. The affidavit says Moore told a witness he fell asleep behind the wheel.

In the emergency room, police say Moore denied taking Xanax. Police say he was also joking and laughing while in the emergency room.

The affidavit says Moore denied taking any alcohol or illegal drugs.

Police secured a warrant for a blood draw. Results will likely take several weeks.
